TERMS & CONDITIONS OF
Extended Warranty
("TERMS")
The term of this Extended Warranty service is 12 months from the date of the manufacturing warranty expires, and ending automatically thereafter.
1) DEFINITION
a) Accessories means any accessory that has been purchased together with your Equipment, but does not include any vehicle installation materials, fixed installation material, software and content downloads.
b) Accidental Damage / Damage / Damaged means: physical breakage , destruction or failure of the Equipment
due to an unforeseen event which causes physical damage to Your Equiment and that prevents it from operating correctly. Accidental Damage extends to include damage as a result of the Equipment being in contact with water and other liquids and damage maliciously caused by anyone.
c) Service Provider means:

d) End user(s) (customer) means the person or company that initially purchased the Equipment in fully new condition or in fully refurbished condition, whether for personal use or for use within the company.
e) Equipment means original branded Smartphones or tablets that are registered under this policy, not later than 1 week after they have been purchased in fully new condition by the End user.
f) Manufacturer means the official and original manufacturer of the Equipment.
g) Extended Warranty Period means a period of twelve (12), starting at the first day of the thirteenth (13th) month after the manufacturing warranty has been expired.
h) Terrorism means any act, including but not limited to, the use of force or violence or the threat threreof, of any person or group of persons whether acting alone or on behalf of or in connection with any organization or government commited for political, religious, ideological or similar purposes including the intention to influence any government or to put the public or any section of the public in fear
i) Theft or Stolen means the taking of Your Equipment by persons known or unknown with the intention of unlawfully and permanently depriving You of possession of Your Equipment.
j) Unattended means when You are not in full view of ; and not in a position to prevent unauthorized interference with Your Equipment.
k) Replacement Equipment means equipment and accessories whic a re paid for by the Service Provider to replace the Equipment. Replacement Items will either be identical to Your Equipment however if the Service Provider is not able to source identical replacements , We will replace the items with equipments that is, in the sole opinion of the Service Provider, equivalent to the insured Equipment. Replacement items will either be new or refurbished items.
l) Virus means any viruses Trojan horses, worms, logic bombs or any program or software which prevents Your Equipment's operating system software or content download working properly or at all.
2) EXTENDED WARRANTY COVER
We cover the Equipment for detects in materials and workmanship when used in accordance with the Manufacturer's user manuals, technical specifications and other Product published guidelines for the period of insurance.
The End users will be able to receive the remedies available under the Extended Warranty Period for their Equipment from the Service Provider. 3) WHAT WILL WE DO IN THE EVENT OF AN EXTENDED WARRANTY CLAIM?
If the End User submits a valid claim under this Extended Warranty Policy during the Extended Warranty Period, We will, at our own option:
I. repair the Equipment using new or previously used parts that are equivalent to new in performance and reliability, or
II. replace the Equipment with the same model (or with the End user's consent a product that has similar functionality) formed from new and/or previously used parts that are equivalent to new in performance and reliability, or
III. refund your purchase price in exchange for the return of your Equipment.
When a product or part is replaced or a refund provided, any replacement item becomes your property and the replaced or refunded item becomes the Service Provider's property.
A replacement part of product of repaired Equipment assumes the remaining Extended Warranty Cover of the original Equipment or ninety (90) days from the date of replacement or repair, whichever provides longer coverage for the End user.
4) WHAT IS NOT COVERED BY THIS WARRANTY?
This warranty does not apply to any other product than the Equipment or any software, even if packaged or sold with the Equipment.
This warranty also does not apply:
(a) to consumable parts, such as batteries or protective coatings that are designed to diminish over time, unless failure has occurred due to a defect in materials or workmanship;
(b) to cosmetic damage, including but not limited to scratches, dents and broken plastic on ports unless failure has occurred due to a defect in materials or workmanship;
(c) to damage caused by use with a third party component or product that does not meet the Manufacturer's Product's specifications.;
(d) to Accidental damage or damage caused abuse, misuse, fire, earthquake or other external cause;
(e) to damage caused by operating the Equipment outside the user manual, the technical specifications or other Product published guidelines;
(f) to damage caused by service (including upgrades and expansions) performed by anyone who is not a representative of the Manufacturer or an Manufacturer Authorized Service Provider ("AASP”);
(g) to Equipment that has been modified to alter functionality or capability without the written permission of the Manufacturer;
(h) to defects caused by normal wear and tear or otherwise due to the normal aging of the Equipment;
(i) if any serial number has been removed or defaced from the Equipment;
(j) if We receive Information from relevant public authorities that the Equipment has been stolen or if the End user is unable to deactivate passcode -enabled or other security measures designed to prevent unauthorized access to the Equipment, and the End user cannot prove in any way that he or she is the authorized user of the product (eg. by presenting proof of purchase).
5) RESPONSIBILITIES END USER
Before submitting the Equipment for Extended Warranty service the End user should make a seperate backup copy of the contents of its storage media, remove all personal information and disable all security password. The contents of the Equipment's storage media may be erased, replaced and / or reformatted in the course of service.
Following Extended Warranty service, the Equipment or Replacement Equipment will be returned to the End User as the Equipment was configured when originally sold, subject to applicable updates. We may install system software updates as part of the Extended Warranty service that will prevent the Equipment from reverting to an earlier version of the system software. Third party applications installed on the Equipment may not be compatible or work with the Equipment as a result of the system software update. The End user will be responsible for reinstalling all other software programs, data and information are not covered under this Extended Warranty.
Following warranty service, your Product or are placement product will be returned to you as your Product was configured when originally sold, su bject to applicable updates , may install system software updates as part of warrranty service that will prevent the Product from reverting to an earlier version of the system software. Third party applications installed on the Product may not be compatible or work with the Product as a result of the system software update. You will be responsible for reinstalling all other software programs, data and information. Recovery and reinstallation of other software programs, data and information are not covered under this warranty.
Before warranty service is provided, the Service Provider or the Administration may require the End user to provide proof of purchase, to answer questions that are designed to diagnose potential problems and to comply with the procedures to obtain Extended Warranty service, including instructions for packaging and sending the insured device.
6) LIMITATION OF LIABILITIES
(a) Entire agreement: This agreement is entered into between the End user and Service Provider. Other parties can in no way hold the Service Provider and / or the Service Provider liable for any damages (direct or indirect) that occur during the fulfillment of obligations arising from this policy, or result from the fulfillment of obligations arising out of this Policy.
(b) The Service Provider does not guarantee or promise that Equipment registered under this Extended Warranty Program can be repaired or replaced without risk to and / or loss of information and / or data stored on the Equipment.
(c) Limitation of liability:
- Subject to clauses (II) and (III) below and to the extent permitted by law, the maximum liability of the Service Provider resulting from and / or connected with this policy, whether based on contractual provisions, tort (including negligence) or otherwise in respect of the execution or intended execution of this Extended Warrant Insurance is limited to the supply (subject to fees and optional) of the Extended Warranty service options described under section 3 above.
- In no event will the Service Provider be liable for:
- Loss of profit; whether
- Loss of goodwill and / or similar losses; whether
- Loss of anticipated savings; whether
- Loss of goods; whether
- Loss of contracts; whether
- Loss of use; whether
- Loss of corruption of data or information; whether
- Special damages, indirect or consequential damages or pure economic loss, costs, damages or expenses.
- The provisions of clause I) above shall not apply to claims for death or personal injury, fraud or illegal provision of false information and / or any other liability which cannot be limited or excluded in the legal sense.
7) PREMIUM PAYMENT
a) Total premium per registered Equipment has to be paid in advanced by the End user to the Service Provider.
8) COMMUNICATION
All statements made by the Service Provider to the Policyholder; or by the End user to the Service Provider shall be deemed to have been done, if done via e-mail, to / by the Service Provider (One Service Republic).
9) COMPLAINTS
We are dedicated to provide the End user with a high quality service, and wants to maintain this at all times. If the End user feels that We have not offered a first class service or they wish to make an enquiry regarding this Extended Warranty Product, please contact One Service Republic.
The Service Provider will try to resolve the End user(s) concerns within 24 hours. If this is not possible they will acknowledge the complaint within 5 working days of receipt and provide a final response within 3 weeks.
10) KEEPING THE PERSONAL DATA OF THE END USERS PERSONAL
We will use the information supplied during the formation and performance of this Extended Warranty Program for claims administration, customer services, paying claims and fraud prevention including passing details to other Service Providers and regulatory bodies. We may disclose information to our subsidiary companies, service providers, agents and suppliers for these purposes. All personal information supplied by the End users will be treated in confidence by the Service Provider and their subsidiary companies, third party service providers, agents and suppliers. It will not be disclosed to any other third parties except where the End user's consent has been received, where permitted by law or regulatory requirements or to assist in the prevention and detection of fraud. Individuals who information has been supplied to the Service Provider have the right to submit a written and signed request for access to or rectification of data held. Telephone calls may be recorded to make sure instructions are correctly followed and for staff training purposes.
11) WHAT LAWS APPLY
THE LAW OF MALAYSIA APPLIES TO THIS PRODUCT.
